Terms of Service for VibeMuse

These Terms of Service ("Terms") govern your access to and use of the VibeMuse iOS mobile application and related websites that link to these Terms (collectively, the "Service"), provided by VibeMuse ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

VibeMuse is a multimodal AI museum guide application that provides AI-generated audio and text descriptions of artworks using image recognition technology. Certain features may be offered free of charge, while other features may require a purchase (including subscriptions or other in-app products) as described in the Service and in the Apple App Store purchase flow presented to you before purchase.

2. Eligibility and User Accounts

You must be at least 13 years of age (or 16 in certain jurisdictions) to use the Service. If you are between 13 and the age of majority in your jurisdiction (a "Minor"), you represent that you have reviewed these Terms with your parent or legal guardian and that they have agreed to these Terms on your behalf. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@vibemuse.app upon becoming aware of any unauthorized use of your account.

3. Paid Features, Subscriptions, and In-App Purchases

3.1 Payment processing.

If you purchase a subscription or other in-app product through the VibeMuse iOS app, payment will be processed by Apple through Apple's in-app purchase system, with Apple acting as the merchant of record for the transaction, subject to Apple's applicable terms and policies. VibeMuse does not directly collect or process your payment card information for purchases made through Apple's in-app purchase system.

3.2 Prices and taxes.

Prices are displayed at the time of purchase in the Apple App Store purchase flow and may vary by region. Taxes, if any, are determined and handled by Apple in accordance with Apple's applicable policies.

3.3 Auto-renewing subscriptions.

If you purchase an auto-renewing subscription through the Apple App Store, your subscription will automatically renew at the end of each subscription period unless you cancel at least 24 hours before the end of the current period, or as otherwise stated in your Apple ID subscription settings. Your Apple ID account may be charged for renewal within 24 hours prior to the end of the current period, unless you cancel earlier through your Apple ID subscription settings.

3.4 Non-subscription products.

Some products (such as limited-time access) may be offered as one-time purchases or non-renewing products. The duration, scope, and renewal behavior will be shown at purchase.

3.5 Manage and cancel.

You can manage or cancel your subscription through your Apple ID subscription settings or the App Store. Canceling a subscription stops future renewals; it does not necessarily refund the current subscription period unless required by applicable law or Apple's policies.

3.6 Restore purchases.

Where supported, you may use Restore Purchases in the app to re-link eligible entitlements purchased through the Apple App Store after reinstalling the app or signing in on a new Apple device, subject to Apple's rules and successful validation.

3.7 Third-party subscription management tools.

We may use third-party services (such as RevenueCat) to help validate purchases and manage entitlements. Those services process purchase-related metadata as described in our Privacy Policy.

3.8 Refunds and billing disputes.

For purchases made through the Apple App Store, billing and refund requests are handled by Apple in accordance with Apple's policies. If you believe you were charged in error, please contact Apple Support using the purchase receipt and transaction history available in your Apple ID account. You may also contact us at support@vibemuse.app for assistance locating your purchase or understanding your entitlement status, but we cannot override Apple's billing or refund decisions where Apple is responsible under its platform rules.

4. Acceptable Use and Restrictions

You agree to use the Service only for lawful purposes and in accordance with these Terms. You strictly agree NOT to:

  • Use any robot, bot, spider, scraper, or other automated device, program, or methodology to access, acquire, copy, or monitor any portion of the Service or the AI-generated content.
  • Attempt to bypass, circumvent, or manipulate any technical limitations, usage quotas, paywalls, or session limits we have implemented to protect our infrastructure or enforce paid entitlements.
  • Use the Service, or any AI-generated text or audio output provided by the Service, to train, fine-tune, or develop any other machine learning models or artificial intelligence systems.
  • Upload images that violate museum photography policies, or infringe upon the intellectual property or privacy rights of any third party.

5. Intellectual Property

The Service and all its original content, features, and functionality (excluding User Content) are the exclusive property of VibeMuse and its licensors and are protected by copyright, trademark, and other applicable intellectual property laws. You retain all rights to the photos you capture or upload. However, the AI-generated artwork guides (including both text and synthesized audio) provided by the Service are licensed to you for personal, non-commercial use only. You may not reproduce, distribute, broadcast, podcast, or monetize the AI-generated content without our prior express written permission.

6. Modifications and Interruption to the Service

VibeMuse reserves the right to modify, suspend, or discontinue the Service (or any part thereof), including but not limited to changing the underlying AI models, adjusting usage limits, changing pricing or product offerings, or altering supported languages, subject to applicable law and any additional rights you may have with respect to paid subscriptions. We will not be liable to you or any third party should we exercise such rights, except where prohibited by law.

7. User Content and Camera/Photo Permissions

When you use the "Snap & Learn" feature, you grant VibeMuse a limited, non-exclusive, royalty-free license to process the images you capture or upload solely for the purpose of generating artwork guides within the Service. Images are processed by our AI partners (OpenAI). For clarity, certain materials (such as compressed images attached to chat messages and your saved guides) may be stored in your account as part of your Chat History and conversation history until you delete them or delete your account, as further described in our Privacy Policy; third-party AI processors may apply their own retention rules to content sent to them.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. VibeMuse relies on third-party service providers (such as OpenAI) to generate guides. We do not guarantee continuous, uninterrupted access to the Service, which may be affected by third-party API downtimes or network latency. Furthermore, the AI-generated artwork guides are for educational and entertainment purposes. Artificial intelligence can produce inaccurate or "hallucinated" information, and VibeMuse does not warrant the accuracy, completeness, or reliability of any AI-generated content.

9. No Affiliation with Museums:

VibeMuse is an independent application. We are not affiliated with, associated with, authorized by, endorsed by, or in any way officially connected with any museum, gallery, or exhibition space (including but not limited to The Metropolitan Museum of Art), or any of their subsidiaries or affiliates. The names of museums as well as related names, marks, emblems, and images are registered trademarks of their respective owners.

10. Limitation of Liability

To the fullest extent permitted by applicable law, VibeMuse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless VibeMuse, its affiliates, and their respective directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your User Content (including uploading images that infringe third-party rights), or your violation of any museum's rules or regulations regarding photography.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion if you violate these Terms. Upon termination, your right to use the Service will cease, without prejudice to any rights or obligations that accrued prior to termination or that survive under applicable law. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations of liability, and governing law) will survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any legal action or proceeding related to the Service shall be brought exclusively in the courts located in Washington, subject to any mandatory consumer protections in your place of residence where applicable law does not permit waiver by contract.

14. Apple-Specific Terms (if you use the iOS application)

If you access the Service through the Apple App Store, you acknowledge that:

  • These Terms are between you and VibeMuse, not Apple.
  • Apple is not responsible for the Service or its content.
  • Apple has no obligation to provide maintenance or support for the Service.
  • If the Service fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price for the Service to the maximum extent permitted by applicable law; Apple will have no other warranty obligation with respect to the Service.
  • Apple is not responsible for addressing any claims relating to the Service or your possession or use of the Service, including product liability claims, legal or regulatory compliance failures, or consumer protection claims.
  • If a third party claims that the Service infringes that third party's intellectual property rights, VibeMuse, not Apple, is responsible for investigation, defense, settlement, and discharge of any such claim to the extent required by these Terms.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms.
  • Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
