Terms of Service for VibeMuse

These Terms of Service ("Terms") govern your access to and use of the VibeMuse mobile application (iOS and Android) and website (collectively, the "Service"), provided by VibeMuse ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Description of Service
VibeMuse is a multimodal AI museum guide application that provides AI-generated audio and text descriptions of artworks using image recognition technology. Currently, the Service is provided to users free of charge.
2. Eligibility and User Accounts
You must be at least 13 years of age (or 16 in certain jurisdictions) to use the Service. If you are between 13 and the age of majority in your jurisdiction (a "Minor"), you represent that you have reviewed these Terms with your parent or legal guardian and that they have agreed to these Terms on your behalf. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@vibemuse.app upon becoming aware of any unauthorized use of your account.
3. Acceptable Use and Restrictions
You agree to use the Service only for lawful purposes and in accordance with these Terms. You strictly agree NOT to:
Use any robot, bot, spider, scraper, or other automated device, program, or methodology to access, acquire, copy, or monitor any portion of the Service or the AI-generated content.
Attempt to bypass, circumvent, or manipulate any technical limitations, usage quotas, or session limits we have implemented to protect our infrastructure.
Use the Service, or any AI-generated text or audio output provided by the Service, to train, fine-tune, or develop any other machine learning models or artificial intelligence systems.
Upload images that violate museum photography policies, or infringe upon the intellectual property or privacy rights of any third party.
4. Intellectual Property
The Service and all its original content, features, and functionality (excluding User Content) are the exclusive property of VibeMuse and its licensors and are protected by copyright, trademark, and other applicable intellectual property laws. You retain all rights to the photos you capture or upload. However, the AI-generated artwork guides (including both text and synthesized audio) provided by the Service are licensed to you for personal, non-commercial use only. You may not reproduce, distribute, broadcast, podcast, or monetize the AI-generated content without our prior express written permission.
5. Modifications and Interruption to the Service
VibeMuse reserves the right to modify, suspend, or discontinue the Service (or any part thereof), including but not limited to changing the underlying AI models, adjusting usage limits, or altering supported languages, at any time without prior notice. We will not be liable to you or any third party should we exercise such rights.
6. User Content and Camera/Photo Permissions
When you use the "Snap & Learn" feature, you grant VibeMuse a limited, non-exclusive, royalty-free license to process the images you capture or upload solely for the purpose of generating artwork guides within the Service. Images are processed by our AI partners (OpenAI). For clarity, certain materials (such as compressed images attached to chat messages and your saved guides) may be stored in your account as part of your Chat History and conversation history until you delete them or delete your account, as further described in our Privacy Policy; third-party AI processors may apply their own retention rules to content sent to them.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. VibeMuse relies on third-party service providers (such as OpenAI) to generate guides. We do not guarantee continuous, uninterrupted access to the Service, which may be affected by third-party API downtimes or network latency. Furthermore, the AI-generated artwork guides are for educational and entertainment purposes. Artificial intelligence can produce inaccurate or "hallucinated" information, and VibeMuse does not warrant the accuracy, completeness, or reliability of any AI-generated content.
8. No Affiliation with Museums:
VibeMuse is an independent application. We are not affiliated with, associated with, authorized by, endorsed by, or in any way officially connected with any museum, gallery, or exhibition space (including but not limited to The Metropolitan Museum of Art), or any of their subsidiaries or affiliates. The names of museums as well as related names, marks, emblems, and images are registered trademarks of their respective owners.
9. Limitation of Liability
To the fullest extent permitted by applicable law, VibeMuse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
10. Indemnification
You agree to defend, indemnify, and hold harmless VibeMuse, its affiliates, and their respective directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your User Content (including uploading images that infringe third-party rights), or your violation of any museum's rules or regulations regarding photography.
11. Termination
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, if you violate these Terms. Upon termination, your right to use the Service will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any legal action or proceeding related to the Service shall be brought exclusively in the courts located in Washington.
